GENERAL TERMS AND CONDITIONS OF SALE – SEASONAL RENTAL

1. PURPOSE

These general terms and conditions govern the rental of furnished accommodations offered by Orindys SRL, intended exclusively for short-term tourist use, located in Belgium.

The rental is concluded on a temporary basis and may under no circumstances constitute a primary or secondary residence.

Any use for professional purposes or as a registered address is strictly prohibited.

2. RESERVATION

The reservation is considered firm and final once the following cumulative conditions have been met:

  • Express acceptance of these Terms and Conditions
  • Payment of a deposit (50%)
  • Written confirmation by email from the landlord

The confirmation email constitutes contractual proof.

  • personal and non-transferable
  • validated based on the timestamp of the booking system

The landlord reserves the right to refuse any reservation in case of:

  • failed payment
  • incorrect information
  • suspicion of fraud

Electronic records stored by the landlord shall constitute proof in case of dispute.

3. PRICE

Prices are indicated in euros (€).

They include:

  • the provision of the accommodation
  • standard utilities (water, electricity, heating), including a reasonable electricity consumption set at 8 kWh per day

Any consumption exceeding this threshold may be charged based on meter readings, at a rate of €0.39 per kWh.

The tenant acknowledges being informed of this mechanism and accepts that any abnormally high consumption may result in additional billing.

May be added:

  • cleaning fees (mandatory)
  • optional services (bed linen, parking or other services offered by the landlord)

4. PAYMENT

Payments are made via the available methods (including secure online payment).

Conditions:

  • deposit upon booking – 50%
  • balance no later than 15 days before arrival

In case of non-payment of the balance within the required timeframe, the reservation will be automatically cancelled without refund of the deposit.

5. SECURITY DEPOSIT

A security deposit of €300 is required.

It covers in particular:

  • material damages
  • additional cleaning
  • non-compliance with rules
  • late check-out
  • loss of keys / badges

The deposit is refunded after the stay, subject to inspection.

6. USE OF THE PROPERTY

  • respect the number of persons declared at the time of booking; any excess occupancy without prior approval from the landlord is prohibited
  • use the property responsibly and with due care
  • respect neighbors and co-ownership rules
  • no parties allowed
  • no subletting

Any breach may result in immediate termination without refund.

In case of disturbance, nuisance or non-compliance, the landlord reserves the right to terminate the stay immediately without refund.

7. ARRIVAL AND DEPARTURE

Check-in: from 3:00 PM
Check-out: before 11:00 AM – except Sunday before 5:00 PM

Access may be provided via an autonomous system (code, smart lock).

The tenant is responsible for the proper use of access systems.

Any unauthorized delay may result in additional charges.

Any loss, disclosure or fraudulent use of access codes or devices is the responsibility of the tenant.

8. CANCELLATION

By the tenant:

  • more than 30 days: free cancellation
  • 30 to 7 days: 50% of the total booking amount
  • less than 7 days: no refund

In case of no-show, the full stay is due.

In case of early departure, no refund will be granted.

By the landlord:

In case of cancellation by the landlord, all amounts paid by the tenant will be fully refunded.

This refund constitutes the sole compensation. The landlord shall under no circumstances be held liable for any additional costs or indirect damages.

9. INVENTORY

The property is deemed to be in good condition upon arrival.

Any issue must be reported within 24 hours.

Failing this, no claim will be accepted.

10. LIABILITY

The tenant is responsible for any damage caused to the property.

The landlord declines all liability in case of:

  • theft
  • loss of personal belongings
  • accidents occurring within the property

The landlord’s liability, in case of proven fault, is limited to the total amount of the booking.

11. INSURANCE

The tenant must hold liability insurance covering rental damages.

12. PETS

Pets are not allowed unless prior written agreement has been obtained.

13. HOUSE RULES

The tenant agrees to comply with the house rules attached to the contract.

14. PERSONAL DATA

Personal data collected is used exclusively for booking management purposes.

In accordance with GDPR, the tenant has the right to access, rectify, object and request deletion of their data.

15. FORCE MAJEURE

The landlord shall not be held liable in case of unforeseen events preventing the rental.

16. APPLICABLE LAW

These terms are governed by Belgian law.

Any dispute shall fall under the jurisdiction of the courts where the property is located.

17. ACCEPTANCE

The reservation implies full acceptance of these general terms and conditions.
